I need legal assistance for pressing charges against Imperial Cnty Sheriffs. where do i search?

Imperial County Sheriffs have had my wife and i spend thousands of dollars to defend ourselves in court at least 3 times this past year just to have the D.A. dismiss all charges. I need legal assistance (free or paid for) but i wish to re-coup by filing charges against them. Who Can HELP?

Reply:The only thing you can do is file a civil rights lawsuit. Ask around for an attorney that works in the area of law and then talk to him. He'll tell you if you have a case or not.
Reply:I didn't do the research for you, but I would research looking for certain lawyers that went after Imperial government agencies and see which/or groups they may be associated with that does pro bono. Start say with lawyers defending the people in Git-mo. Then the Waco victims. more recently the over 400 kids removed from homes in Texas. The list is long and the lawyers are an abused (by the government) , but most seem dedicated lot.....Mary.
Reply:The Yellow pages will give you a large list of lawyers and what they practice. If the Cops spent that much time nd effort trying too bust youthey did not do it for nothing. If I were you I would just let it go because if you are a criminial they will get you sooner or later and throw the book at you at sentancing. My advice too you is too stop yur drug dealing before they can actually convict you. I am very familiar with how much drug daling goes on in Imperial County.

Reply:First, you are NOT trying to press charges. You are trying to sue in CIVIL court. In the US, only the DA can press CRIMINAL charges. In any case, you want money. That means CIVIL, not CRIMINAL court.


Second, the Sheriff did not make you spend a dime to defend yourself. If the DA had not pressed charges, you would never have appeared in court. The fact they latter dropped the charges does not mean the were not the one to file them.
Reply:Go talk to a lawyer. Unless the charges are ridiculously bogus you probably won't have much luck.





No judge is going to award you anything as long as the arrests/charges were made based on probable cause.
Reply:You look in the Yellow Pages under Legal Aide there will be an office you can call and then they will give you another number to call in the evening and you will tell your story to a Para-Legal or a Law student. They take all of your information and discuss it with real Attorney's and then they call you back the same night and tell you what you can do. It's pretty good. There is also an office you can go to and it's on a first come, first serve basis.


You didn't mention what the charges were but the D.A. is the one that pressed the charges and there must have been something you or your wife were doing that got their attention. You could have asked for a Public Defender if you could not afford counsel I don't know of any court that reimburses people for their private attorney fees when fighting a case or cases, that is why you are allowed to have Public Defenders.


The way I understand the courts and the law is that if you are charged with something, you have the right to be heard to clear your name. The Sheriff nor the court MADE you spend ANY money, it was your choice and obviously a good one because they dropped all charges.


I don't see how you can collect any monies that you chose to spend. Who do you want to pay you? The courts are elected by the people and for the people, that's the judges and the D.A.'s. and paid for with our tax dollars. I'm not sure what entity you want to reimburse you. I've never seen a case that has been paid but you can always try. A crime has not been comitted by ICS or the D.A. so who are you going to charge and with what would be the charge?
